Terms of Service

Nudge is in active development. The service is available for people to try, but features are still being added and these Terms will be updated as they launch. Sections describing something that is not yet available say so. Questions: hello@nudgeactivity.com.

1. Who we are and acceptance

Nudge ("Nudge", "we", "us") is operated by Espen Joli, a sole trader based in Torrevieja, Alicante, Spain. By creating an account or using nudgeactivity.com or the Nudge app ("the Service"), you agree to these Terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract to use Nudge. By using the Service you confirm that you are.

3. Your account

You are responsible for the activity on your account and for keeping your login secure. Provide accurate information and keep it up to date. Tell us promptly at hello@nudgeactivity.com if you suspect unauthorised use.

4. The Service

Nudge helps people discover, post and join local social activities, connect with others, and message the people they connect with. Because the Service is still in development, we may add, change or remove features, and parts of it may be unavailable from time to time.

5. Your content

You keep ownership of the activities, photos, messages and other content you post. You grant us a non-exclusive, worldwide, royalty-free licence to host, store and display that content solely to operate and provide the Service, for example by showing your activity in the feed to nearby users. This licence ends when you delete the content or your account, except for copies retained in routine backups or as required by law.

You are responsible for your content and confirm you have the right to post it.

6. Acceptable use

You agree not to:

• post content that is unlawful, misleading, hateful, harassing, sexually explicit, or that endangers minors;
• impersonate others or misrepresent who you are;
• harass, threaten, spam or defraud other users;
• use the Service for any commercial purpose we have not authorised;
• scrape, reverse-engineer, overload or attempt to breach the Service or its security;
• post another person's private information without their consent.

We may remove content and suspend or terminate accounts that break these rules.

7. Activities and safety: important

Nudge is a platform for meeting people. We do not organise, host, vet, or supervise activities, and we do not run background checks on users. You interact with and meet other people at your own risk. Please use good judgement: meet in public places, tell someone where you are going, and look after your own safety. To the extent permitted by law, Nudge is not responsible for the conduct of any user or for anything that happens at an activity.

8. Reporting and moderation

You can report content or users to us. We review reports and may remove content, warn, suspend or ban users at our discretion. This does not make us responsible for monitoring all content.

9. Nudge Pro

Paid subscriptions are not yet available. No payment is currently taken and no billing details are collected. When Pro launches, these Terms will be updated before anyone is charged, and the following will apply:

• Billing: Pro will be a recurring subscription, monthly or annual, sold through a Merchant of Record who handles payment, invoicing and applicable VAT. Your purchase will also be subject to their terms.
• Renewal and cancellation: subscriptions renew automatically until you cancel. You can cancel at any time; access continues until the end of the paid period.
• Refunds and withdrawal: EU consumers have a 14-day right of withdrawal. By starting a digital subscription you may agree that the service begins immediately, which can affect that right. We otherwise give refunds where required by law.
• Changes: Pro features and pricing may change with reasonable notice. Price changes do not affect a period you have already paid for.

10. Intellectual property

The Nudge name, logo, design and software are owned by us and protected by law. These Terms do not give you any right to use them beyond using the Service as intended.

11. Third-party services

The Service relies on third parties, including Supabase, Cloudflare, Google Maps and OpenStreetMap. Their availability is outside our control, and your use of features they power may be subject to their terms.

12. Disclaimers

The Service is provided "as is" and "as available", and is still in development. We do not guarantee it will be uninterrupted, error-free, or that content posted by users is accurate or lawful. We disclaim all warranties to the fullest extent permitted by law.

13. Limitation of liability

To the fullest extent permitted by law, Nudge is not liable for indirect, incidental or consequential losses, or for loss of data, profit, or opportunity. Nothing in these Terms excludes liability that cannot be excluded by law, such as for death or personal injury caused by our negligence, or your mandatory rights as a consumer. Where we are liable, our total liability is limited to the greater of the amount you paid us in the last 12 months or €50.

14. Termination

You may stop using Nudge and delete your account at any time (Settings → Delete account). We may suspend or terminate your access if you breach these Terms or to protect the Service or other users.

15. Governing law

These Terms are governed by the laws of Spain. If you are a consumer, you benefit from any mandatory protections of the country where you live, and disputes may be brought in the courts of your place of residence.

16. Changes to these Terms

We may update these Terms. If a change is significant we will notify you in the app or by email. Continuing to use the Service after a change means you accept the updated Terms.
